General Terms & Conditions and Cancellation Policy

(version: March 2020)

1. Information about ordering concert tickets

a) Ordering tickets using the Service GmbH of the Schleswig-Holstein Musik Festival

Starting 20 February 2020, you will be able to order binding entrance tickets in writing by mail and fax as well as from our website. Please send written orders to:

Ticketing Office
Schleswig-Holstein Musik Festival
Postfach 3840
24037 Kiel
Germany
Fax +49 431-23 70 711
bestellung@shmf.de

The SHMF Service GmbH will start taking telephone orders on March 13, 2020 at +49 431-23 70 70 (Monday to Friday 9 am- 6 pm).

b) Purchasing concert tickets from ticketing agencies

Starting March 13, 2020 concert tickets will be available for purchase from several festival ticketing agencies. The general terms & conditions of the corresponding ticketing agencies apply.

c) Purchasing concert tickets from the box office

Any remaining tickets, if available, can be purchased at the event box office.

2. Conclusion of contract

Your order represents a binding offer to conclude a sales contract for the ordered concert tickets. Upon placing your order, the Schleswig-Holstein Musik Festival Foundation will send you a confirmation e-mail with all the order details (order confirmation). This order confirmation does not constitute the acceptance of your order, it is simply to confirm its receipt. A sales contract only enters into force once the ordered concert tickets are shipped or an invoice for the order is sent. The concert tickets are shipped once payment is received.

3. Cancellation policy

a) Entrance tickets

Insofar as the SHMF Service GmbH offers entrance tickets for events, this does not constitute a distance selling contract in accordance with Sec. 312b of the German Civil Code (BGB). This means that a right of cancellation and return does not exist. Every purchase of concert tickets is thus immediately binding once the SHMF Service GmbH confirms the order and obligates the purchaser to accept and pay for the ordered tickets.

b) Merchandising items (CDs, etc.)

Right of cancellation

You have the right to cancel this contract within 14 days without reason. The right of cancellation is valid for 14 days after the day on which you or a third party named by you who is not the purchaser took the goods into possession. To exercise your right of cancellation, you must send (e.g., by mail, fax or e-mail) a clear statement concerning your decision to cancel this contract to

SHMF Service GmbH
Liesenhörnweg 7-11
24222 Schwentinental
Germany
Fax +49 431-23 70 7-189
service@shmf.de

You may use the attached cancellation form template, but it is not required. You may also electronically complete and submit the cancellation form template or transmit another clear statement via our website www.shmf.de. If you make use of this option, we will immediately send you (e.g., by e-mail) confirmation of receipt of the cancellation. To meet the cancellation deadline, it is sufficient to send the cancellation notice before the end of the cancellation period.

Cancellation consequences

Should you cancel this contract, we will refund to you all payments we have received including the cost of delivery (except for any additional costs if you selected a shipping method that is more expensive than the least expensive standard delivery method we offer) immediately, however, within a period of 14 days at the latest from the date on which we received the notice of cancellation of this contract. For the refund, we will use the same means of payment you used for the original transaction, unless we have expressly agreed otherwise; in no case will you be charged any fees for the refund. We may refuse the refund until we have recovered the goods or until you have provided proof that you have returned the goods, whichever is sooner.
You must return or surrender the goods to us immediately and, in any case, no later than 14 days from the date on which you notified us of the cancellation of this contract. This deadline is honored if you send the goods before the end of the period of 14 days.
We pay the cost of return shipment of the goods.
You are only liable for any loss in value of the goods if the loss in value is attributable to a handling which is not necessary for checking the quality, characteristics or functioning of the goods.

Exclusion of cancellation

The right of cancellation is excluded for contracts:

  • for the delivery of sound or video recordings or computer software in a sealed package if the seal has been removed after delivery;
  • for the delivery of newspapers or magazines except for subscription contracts

End of the cancellation policy

4. Acceptance of ticket orders

Ticket orders can only be accepted if a sufficient number of tickets are still available. Orders are processed in the order in which they are received. If we cannot process your order, we will inform you immediately.

5. Delivery

The concert tickets will be sent by mail once payment is received.

6. Prices and payment methods

a) Prices

The indicated prices are the end prices of SHMF’s ticketing office. Associated ticketing agencies charge a 10% agency fee and a system fee, if applicable. High school and college students, apprentices and active members of the military service or the Federal Volunteer Service (up to 27 years old) receive a discount of 50%, unless a different discount is advertised for individual concerts. A valid ID proving the status must be presented at the event entrance. A general service fee of €3.90 is charged.

b) Payment methods

Over the phone: Payment methods accepted over the phone are credit card (VISA or MasterCard), bank transfer or check.
Orders in writing: With a direct debit authorization, the tickets are sent directly. Otherwise, you will receive an invoice with payment information and details about the tickets you have reserved once your order is processed. When using a bank transfer or check payment method, the tickets will be sent to you. Do not enclose cash or a check with your order.

7. Wheelchair spaces

Spaces for wheelchairs are available at most events. Contact the ticketing office for information and sales.

8. General provisions

Visitors late to an event will only be admitted at intermission. Tickets lose their validity once the visitor leaves the event. Audio, photo, film and video records are prohibited, event for private use. Infringements will be prosecuted. Individual events will be recorded by radio and/or television broadcasting companies. The ticketholder agrees to this and the possible capture of his/her person. Please consider adequate clothing in adverse weather conditions.
Ticket returns and exchanges are not possible even if orders are only partially fulfilled. However, the Schleswig-Holstein Musik Festival Foundation will not arbitrarily limit the number of tickets you order for each concert. Changes to programs, line-up and dates and times are always reserved. Line-up and program changes do not justify the return of tickets. Only in the event of a general cancellation of an event will the purchase price be refunded within two months of return of the tickets.

9. Data privacy

The information required for the business transaction is stored and may be passed on to our service partner, the ticketing office of the Schleswig-Holstein Musik Festival (SHMF Service GmbH), which acts as a commissioned data processor in the sense of the German Federal Data Protection Act for processing the order. To inform you as much as possible about the festival program, about changes or about the status of your order (including by e-mail and text), we store the personal information you provide during the program or ticket ordering process on data carriers. Your information will not be forwarded to third parties.

According to the German Federal Data Protection Act, you have the right to free information about the information we store. At the request of the customer, the Schleswig-Holstein Musik Festival Foundation will immediately correct, block or delete the personal customer master data. However, deletion is only possible once the ordering process is complete. The deletion occurs under consideration of the limitations imposed by the tax authority.
